1. Acceptance of Terms
By creating an account on Opsary or using the service, you agree to these Terms of Service.
If you do not agree, do not use the platform.
2. Description of the Service
Opsary allows users to:
Create reusable processes
Run projects with step-by-step structure
Assign steps to team members
Trigger automated actions and email notifications
Manage clients and projects
Use email credits for notifications
Opsary is a SaaS application hosted and operated via Emergent.
3. Eligibility
You must be at least 18 years old and capable of entering into a legal contract.
4. Account Registration
You must provide accurate information during signup.
You are responsible for:
maintaining confidentiality of your account
all activity under your account
securing your password
5. Billing & Payments (via Paddle)
Opsary uses Paddle as Merchant of Record.
All payments, invoicing, and tax processing are handled by Paddle.
By subscribing, you agree to Paddle’s Terms and Privacy Policy.
5.1 Subscription Plans
Free / Pro / Scale.
Each plan includes limits on:
number of active projects
number of clients
email credits
automation volume
team members
Plan descriptions and limits are displayed on opsary.com/pricing.
5.2 Renewal
Subscriptions renew automatically until cancelled.
5.3 Payment Failures
If Paddle cannot charge your method:
Opsary may downgrade your workspace
Access to some features may be restricted
5.4 Additional Charges
Email credits and additional team members are billed separately.
6. Free Trials
Opsary may offer free trials for Pro or Scale.
Trials include limited email credits.
After expiration, your account downgrades to the Free plan automatically.
7. Refund Policy
Refunds follow our Refund Policy page.
Refunds are handled directly by Paddle.
8. Cancellation
You may cancel anytime via your Paddle subscription management page.
Cancellation takes effect at the end of the billing cycle.
Access remains active until expiration.
9. User Content
You retain full ownership of all data you upload or create in Opsary.
By using the service, you grant Opsary a temporary license to store, process, and display your data solely for service operation.
Opsary does not access or use your data for any other purpose.
10. Prohibited Use
You may not:
reverse engineer the platform
attempt unauthorized access
use Opsary for illegal activities
send spam or misuse email automations
manipulate billing or limits
Violation results in immediate account suspension.
11. Availability & Updates
Opsary may update or modify the service at any time.
We strive for uptime but do not guarantee uninterrupted availability.
12. Security
Opsary uses modern security measures but cannot guarantee absolute protection.
You are responsible for securing your account.
13. Data Protection & Privacy
All processing follows:
Swiss data protection laws
GDPR requirements
Our Privacy Policy explains how personal data is handled.
14. Third-Party Services
Opsary integrates with:
Paddle (billing)
Resend (email sending)
Emergent (application infrastructure)
These providers have their own legal terms.
15. Termination
Opsary may terminate accounts that:
violate these terms
misuse automations
cause security threats
fail to pay after repeated attempts
After termination, data may be deleted permanently.
16. Limitation of Liability
Opsary is provided “as is”.
MM Management Agency Sàrl is not liable for:
loss of data
interrupted service
indirect or consequential damages
financial losses resulting from misconfigurations or user errors
Maximum liability = total amount paid in the last 12 months.
17. Modifications to Terms
We may update these terms at any time.
Continued use of Opsary indicates acceptance of the updated terms.
18. Governing Law
These terms are governed by Swiss law.
Any disputes fall under the jurisdiction of courts in Vaud, Switzerland.
